Effective date: October 9, 2026
These Terms are an agreement between you and Amo Per La Vita LLC ("Mia", "we", "us") and govern your use of the Mia app and website (the "Service"). By creating an account or using Mia, you agree to these Terms, our Privacy Policy, our Biometric Data Policy and our Community Guidelines. If you don't agree, don't use Mia.
1. Who can use Mia
- You must be at least 18 years old.
- You must be able to form a binding contract, not be barred from using the Service under applicable law, and not have been removed from Mia before.
- You may not use Mia if you have been convicted of a violent or sexual offense.
- One person, one account. Your account is personal and can't be shared or transferred.
2. Your account
- You sign up with a mobile phone number (verified by text message). You may also link Sign in with Apple or Google.
- New profiles are reviewed before they become visible. We may approve a profile, ask for changes, or decline it. A declined applicant may reapply after 90 days.
- You're responsible for keeping your phone and sign-in methods secure and for activity on your account.
- Keep your information accurate. Don't impersonate anyone or misrepresent your age, identity or photos.
3. How Mia works
- Everyone receives three profiles a day, chosen for them. Paying doesn't change that number.
- When two people like each other, it's a match. A match expires after 7 days unless one of you sends a message; once a conversation starts, it doesn't expire.
- Direct Messages let you message someone before matching. A request expires after 14 days if it isn't answered; if it's declined, you can't send that person another request for 30 days.
- Verified members are shown only to other verified members, and a profile that hasn't been verified isn't shown to them. Photo verification is described in the Biometric Data Policy.
4. Your content
- You own what you post (photos, bio, prompts, messages). You grant Mia a worldwide, non-exclusive, royalty-free license to host, store, display and process that content to operate and improve the Service. The license ends when your content is deleted, except where it has been shared with others (for example messages already delivered) or we must keep it for safety or legal reasons.
- You confirm you have the rights to everything you post and that it follows our Community Guidelines.
- We may review, refuse or remove content and may pause or remove accounts that break these Terms.
5. Conduct
Don't use Mia to harass, threaten, scam, solicit money, sell anything, advertise, recruit for sex work, post sexual or violent content, share someone else's private information, or for any illegal purpose. Don't scrape, reverse-engineer, interfere with or automate the Service, or create accounts by automated means. The full rules are in the Community Guidelines.
6. Safety and your interactions with other members
MIA DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS OF ITS MEMBERS.
Mia can't guarantee the identity, intentions or conduct of other members. A "Verified" badge means a selfie matched the member's photos; it doesn't verify anything else. You're solely responsible for your interactions with other members, online and in person — read our Safety tips and use Block and Report whenever something feels wrong.
To the fullest extent permitted by law, you release the Mia Parties (defined in section 10) from claims, demands and damages of every kind, known and unknown, arising out of or connected with disputes or interactions between you and other members or anyone you meet through the Service. If you live in California, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This release doesn't apply to claims that can't be released by law.
7. Mia Ultra and Direct Message packs
- Mia Ultra is an auto-renewing monthly subscription ($19.99/month in the U.S.; local prices are shown in the app). It includes: seeing who likes you, being prioritised in other members' daily selections, 2 Direct Messages a month (unused ones don't roll over), the preference boost, rewinding your last pass of the day, and extending a match once by 7 days. Features may change; we'll describe what's included in the app at the time you buy.
- Billing. Payment is charged to your Apple ID at confirmation. The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel in your App Store account settings. Cancelling stops future renewals; you keep Ultra until the end of the period you've paid for.
- Direct Message packs (3, 10 or 25 messages) are one-time purchases. Purchased messages don't expire while your account exists. They have no cash value and can't be transferred or refunded by Mia except as required by law.
- Refunds for App Store purchases are handled by Apple under Apple's policies (reportaproblem.apple.com). If Apple refunds a purchase, the related subscription or messages are removed from your account.
- Deleting the app doesn't cancel a subscription — cancel it in your Apple ID settings.
8. Ending your account
- You can delete your account in the app (Settings) or at miadatingapp.com/account/delete. Your profile is hidden immediately; your data is permanently deleted after a 30-day grace period, during which signing back in cancels the deletion. Some records are kept as described in the Privacy Policy.
- We may suspend or terminate accounts that break these Terms or put others at risk, with or without notice. Paid features aren't refunded when an account is removed for breaking these Terms, except where the law requires.
- If we remove an account, we may tell members who exchanged messages with it the member's first name and the general reason, so they can protect themselves.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, the Mia Parties disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't promise you'll find a match, that other members are who they say they are, or that the Service will be uninterrupted, secure or error-free.
10. Limitation of liability
"Mia Parties" means Amo Per La Vita LLC and its affiliates, and each of their members, managers, officers, employees, contractors and agents.
To the fullest extent permitted by law:
- The Mia Parties won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or opportunities, however caused.
- The Mia Parties won't be liable for the conduct, statements or content of any member or third party, on or off the Service, including anyone you meet through Mia.
- The Mia Parties' total liability for all claims relating to the Service is limited to the greater of the amount you paid Mia in the 12 months before the event giving rise to the claim, or US $100.
- Any claim relating to the Service may be brought only against Amo Per La Vita LLC, and not against any of its members, managers, officers or employees personally.
These limits apply to every theory of liability and even if we were told a loss was possible. Some places don't allow certain limits, so some of these may not apply to you. Nothing in these Terms limits liability that can't be limited by law.
11. Indemnity
You agree to defend, indemnify and hold harmless the Mia Parties from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of your content, your use of the Service, your interactions with other members, or your breach of these Terms or of any law.
12. Disputes, arbitration and class-action waiver
Please read this section carefully. It requires disputes to be resolved by individual arbitration instead of in court, and it waives your right to a jury trial and to take part in a class action. You can opt out (section 12.8).
12.1 Governing law. These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. This section 12 is governed by the Federal Arbitration Act (FAA).
12.2 Talk to us first. Before starting an arbitration or court case, you and Mia agree to try to resolve any dispute informally. The party with a claim must send a written notice that includes their name, the phone number or email on the account, a description of the dispute and the relief requested. Your notice must be signed by you personally and sent to support@miadatingapp.com or to the address in section 16. If either side asks, we'll meet by phone or video, individually, within 45 days. If the dispute isn't resolved within 60 days after the notice is received, either side may start arbitration. Any limitation period is paused during this process. Completing it is a condition to starting arbitration or a court case.
12.3 Binding individual arbitration. Except as provided in 12.5 and 12.8, any dispute, claim or controversy between you and any of the Mia Parties arising out of or relating to these Terms, the Service or your relationship with Mia (a "Dispute") will be resolved by final and binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms, before a single arbitrator. The rules are available at adr.org.
12.4 How it works. The arbitrator may award any individual relief a court could award, but only in favour of the individual party seeking relief and only to the extent needed for that party's individual claim. Hearings may take place by video or phone, or on written submissions; any in-person hearing will be in the county where you live or in Rockland County, New York, at your choice. Fees are paid as the AAA Consumer Arbitration Rules provide, which caps the filing fee a consumer pays; Mia pays the rest of the AAA's fees except where the arbitrator finds a claim frivolous or brought for an improper purpose. The arbitrator, and not any court, decides questions about the interpretation, scope, validity and enforceability of this section 12, except that a court decides disputes about 12.6 and 12.7.
12.5 Exceptions. Either side may bring an individual claim in small-claims court if it qualifies and stays there. Either side may also go to court to stop actual or threatened infringement, misuse or violation of intellectual property rights, or unauthorised access to or interference with the Service.
12.6 Class-action and jury-trial waiver. You and Mia may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims of more than one person or preside over any class or representative proceeding. You and Mia each waive the right to a trial by jury. If this waiver is found unenforceable for a particular claim or remedy, that claim or remedy (and only that one) will be decided in court under 12.9, after all individual claims are arbitrated, and not in class arbitration.
12.7 Mass arbitration. If 25 or more similar demands are filed against Mia by or with the help of the same or coordinated counsel, the AAA's Mass Arbitration Supplementary Rules also apply, and the demands will be administered in batches of up to 50, with one arbitrator assigned to each batch. Each claim in a batch is still decided individually, on its own facts, with its own hearing and award; no outcome in one claim binds any other claimant. Limitation periods are paused for claims waiting to be batched. A court may enforce this paragraph.
12.8 Opting out. You can opt out of this agreement to arbitrate within 30 days after you first accept these Terms by emailing support@miadatingapp.com with the subject "Arbitration opt-out", your name, and the phone number or email on your account. Opting out doesn't affect any other part of these Terms.
12.9 Courts. Any Dispute not resolved by arbitration will be decided exclusively by the state courts located in Rockland County, New York, or the United States District Court for the Southern District of New York, and you and Mia consent to their personal jurisdiction.
12.10 Time limit. To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
12.11 Changes to this section. If we change this section 12, the change won't apply to any Dispute you've already told us about, and you may reject a material change by emailing us within 30 days of the change, in which case the version you previously accepted continues to apply to you.
12.12 Severability. Except as stated in 12.6, if any part of this section 12 is found unenforceable, the rest still applies.
13. Changes
We may update these Terms. If a change is material, we'll tell you in the app before it takes effect, and where required we'll ask you to accept the updated Terms. Continuing to use Mia after an update takes effect means you accept it. Changes to section 12 follow 12.11.
14. Apple
These Terms are between you and Mia, not Apple. Apple isn't responsible for the Service or its content, has no obligation to provide support, and isn't responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. General
These Terms (with the policies they link to) are the entire agreement between you and Mia about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
